Terms of sale
These terms apply to all orders placed on www.herapreg.com by consumers, whatever the country of delivery.
1. Who we are
The website www.herapreg.com (the "Site") is operated by FEMMA, a French simplified joint-stock company (SAS) with share capital of €1,000, whose registered office is at 143 avenue du Général Leclerc, 91330 Yerres, France, registered with the Évry Trade and Companies Register (RCS) under number 899 848 717, EU VAT number FR79 899 848 717, represented by Emmanuelle Santos Pereira. Herapreg is a trading name of FEMMA.
Customer service: bienvenue@herapreg.com or the form on our Contact page.
2. Scope
These terms of sale (the "Terms") apply to sales concluded on the Site between FEMMA and any natural person acting for purposes outside their trade, business or profession (the "Customer"). Healthcare professionals and resellers who buy through the professional area are subject to specific terms.
The Customer accepts the Terms by ticking the box provided for this purpose before confirming their order. The applicable Terms are those in force on the date of the order. They are available in French, English and Spanish; the contract is concluded in the language used by the Customer to place their order.
3. Products
The main characteristics of the products are set out on their product page. Photographs are as accurate as possible but are not contractually binding.
Some sizes may be ordered while they are being restocked. In that case, the expected dispatch date is shown in the size name on the product page, before the order is placed.
If an ordered product turns out to be unavailable, we inform the Customer without delay. The Customer may then choose to wait, to exchange it for another available size or to be refunded. The refund is made no later than 14 days after the Customer's request.
4. Prices
Prices are shown in euros. For deliveries to France and the European Union, they are displayed inclusive of all taxes (VAT included). Delivery charges are shown before the order is confirmed and are added to the price of the products.
For deliveries outside the European Union, the price displayed may not include the VAT or customs duties of the destination country. These duties and taxes, if due, are collected by the carrier or the authorities of the country of delivery and are payable by the Customer.
The applicable price is the one displayed at the time of the order. Promotional prices apply for the entire announced duration of the promotion.
5. Ordering
To place an order, the Customer:
- adds the product or products to their basket;
- enters their contact details and delivery address and chooses a delivery method;
- checks the order summary (products, size, total price, delivery charges) and can correct any error;
- accepts these Terms;
- confirms the order by clicking the payment button, which constitutes an order with an obligation to pay.
The contract is concluded when payment is confirmed. An order confirmation summarising the contract is sent to the Customer by email; it contains a link to their invoice. We advise the Customer to keep this email.
FEMMA may refuse or cancel an order in the event of an existing dispute with the Customer, a declined payment or suspected fraud.
6. Payment
Payment is made in full at the time of the order, using the methods offered on the checkout page (debit or credit card, PayPal, Apple Pay or Google Pay depending on the device and country). Payments are processed by secure payment providers; FEMMA never has access to full card details.
7. Delivery
We deliver to the countries offered on the checkout page. The delivery methods, rates and times available for the Customer's address are displayed there before the order is confirmed. Full details are set out in our shipping policy.
Orders are prepared within 24 to 96 working hours (up to 10 working days during busy periods) and then handed over to the carrier. Unless a different date is indicated before the order is placed, the product is delivered no later than 30 days after the order. If this deadline is exceeded, the Customer may cancel their order under the conditions provided for by law and obtain a refund.
The Customer receives a dispatch email with a tracking number. The risk of loss or damage passes to the Customer when they (or a person they have designated) take physical possession of the parcel. If a parcel is declared lost by the carrier, we either refund the order in full (products and delivery charges) or send it again, as the Customer prefers.
If a parcel is returned to the sender because it was not collected or because the address entered was incorrect, we contact the Customer to offer either redelivery, at their expense, or a refund of the products.
8. Right to cancel and returns
Your cancellation period: 15 days
The law gives the Customer 14 days to cancel, without giving any reason and without paying any penalty. We extend this to 15 days from the day on which the Customer (or a third party designated by the Customer, other than the carrier) receives the product.
Try before you decide
So that the Customer can assess the product properly, we accept returns even after it has been worn, including without sanitary protection. We recommend wearing it over cotton leggings or cycling shorts for the first few days. The product must come back free of stains and damage: if it comes back damaged beyond what normal trying-on involves, we may deduct the resulting loss in value from the refund. Returned products are never resold as new; they are disinfected and then donated to charities or healthcare facilities.
How to cancel
The Customer informs us of their decision before the end of the cancellation period by means of a clear statement:
- using the form on our Contact page, reason "return", stating their order number;
- or by email to bienvenue@herapreg.com;
- or by sending us the model cancellation form set out in the annex (its use is not compulsory).
The Customer then sends the product back no later than 14 days after informing us, to the following address:
HERAPREG / E2IS – Service logistique, 1 avenue du Maréchal Lyautey, 91230 Montgeron, France.
Return costs are paid by the Customer. The parcel remains the Customer's responsibility until it is received by our warehouse: we recommend keeping proof of postage.
Refund
We refund the price of the product and the original delivery charges (up to the cost of the least expensive standard delivery option we offer) no later than 14 days after being informed of the cancellation. We may withhold the refund until we have received the product or until the Customer has supplied proof of having sent it back, whichever is earlier. The refund is made using the payment method used for the order, free of charge.
Size exchange
A Customer who would like a different size requests it through the contact form, reason "exchange". The Customer returns the product at their own expense; we cover the preparation and shipping of the new size.
9. Legal guarantees
All our products are covered by the legal guarantee of conformity and the legal guarantee against hidden defects. No additional commercial guarantee is offered.
The following notice is required by French law (translation):
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for giving back the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request the repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights set out above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for giving back the goods.
Customers resident outside France. The legal guarantee of conformity lasts at least two years throughout the European Union; the law of your country may provide for a longer period (for example three years in Spain), which then applies. In the United Kingdom, the Consumer Rights Act 2015 notably allows you to reject goods that do not conform to the contract within 30 days for a full refund, and then to request their repair or replacement.
To make any claim under the guarantees, simply write to bienvenue@herapreg.com with your order number and photos of the defect. Return costs for a defective product are paid by us.
10. Liability
FEMMA is not liable for any failure to perform the contract that is attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure. Nothing in these Terms limits the rights the Customer has under the law of their country of residence.
11. Personal data
The data collected when an order is placed is used to process and deliver it and to provide customer service. How it is processed and the Customer's rights (access, rectification, erasure, objection, portability) are described in our privacy policy. The Customer may exercise these rights by writing to bienvenue@herapreg.com and may lodge a complaint with the data protection authority of their country (the CNIL in France).
12. Intellectual property
The texts, photographs, visuals and trade marks on the Site are the property of FEMMA or its partners. Any reproduction without written permission is prohibited.
13. Complaints
For any complaint, the Customer should first write to bienvenue@herapreg.com; we undertake to reply promptly.
14. Governing law and jurisdiction
These Terms are governed by French law. If the Customer resides in another country of the European Union or in the United Kingdom, they also benefit from the mandatory consumer protection provisions of their country of residence, from which these Terms cannot derogate.
In the event of a dispute, the Customer may bring proceedings either before the courts of their place of residence or before the competent French courts.
